SEP Law

SEP Law (Standard Essential Patent Law) refers to the legal framework governing patents that are essential to implementing a standardized technology. These patents, known as Standard Essential Patents (SEPs), cover inventions that are indispensable for compliance with a particular industry standard, such as those related to wireless communication (e.g., 4G, 5G), video codecs, or other broadly adopted technologies.

The key characteristic of SEP law is the commitment by the patent holder to license the SEPs on Fair, Reasonable, and Non-Discriminatory (FRAND) terms. This commitment is typically made to the standard-setting organization (SSO) that develops and promulgates the standard. The FRAND undertaking aims to balance the interests of the patent holder, who deserves compensation for their innovation, and the implementers of the standard, who need access to the essential technology to build compliant products.

Key Issues in SEP Law:

• FRAND Licensing: Defining and determining what constitutes "Fair, Reasonable, and Non-Discriminatory" terms is a central and often contentious issue. Litigation often arises over the royalty rates, licensing scope, and other terms offered by SEP holders. Different jurisdictions have adopted different approaches to interpreting FRAND, leading to varying outcomes in SEP disputes.

• Portfolio Licensing: SEP holders often have large portfolios of essential patents. Determining the aggregate royalty burden resulting from multiple SEP portfolios is a complex issue. Implementers argue that the cumulative royalties demanded by SEP holders can be excessively high, leading to "royalty stacking."

• Injunctions: The availability of injunctive relief (an order to stop the infringing activity) against implementers who refuse to take a license is another key area of contention. Courts often consider whether the SEP holder has adhered to their FRAND obligations before granting an injunction. Refusal to negotiate a license on FRAND terms, or seeking excessive royalty rates, may weigh against granting an injunction.

• SEP Validity and Essentiality: Disputes can arise over whether a patent is truly essential to the standard and whether the patent itself is valid.

• Enforcement: SEP law is enforced through patent infringement litigation, often in multiple jurisdictions, which can be complex and expensive.

Importance:

SEP law is critically important for the development and adoption of standardized technologies. It seeks to ensure that essential technology is accessible to all implementers on reasonable terms, fostering innovation and competition. However, the interpretation and application of FRAND principles remain challenging, leading to ongoing legal and policy debates.
