High Council of Justice (Ukraine)

The High Council of Justice (HCJ) of Ukraine (Ukrainian: Вища рада правосуддя, Vyscha Rada Pravosuddya) is an independent constitutional body responsible for the formation of a highly professional and impartial judiciary, and ensuring its independence and functioning. It operates based on the principles of the rule of law, independence, transparency, and accountability.

The HCJ's main functions include:

  • Nominating judges for appointment by the President of Ukraine.
  • Deciding on the transfer, secondment, and dismissal of judges.
  • Exercising disciplinary authority over judges, including initiating disciplinary proceedings and imposing sanctions.
  • Protecting the independence of judges and courts from interference in their activities.
  • Verifying complaints against judges and other court officials.
  • Participating in the budgetary process for the judicial system.
  • Providing advice and recommendations on matters related to the judiciary.

The composition of the HCJ includes judges, prosecutors, lawyers, and scholars of law. Some members are appointed by various institutions, including the Congress of Judges, the President, the Parliament (Verkhovna Rada), and the Prosecutor General's Office, while others are elected directly by their peers. The structure aims to ensure a diverse representation of the legal profession and society.

The HCJ plays a crucial role in judicial reform in Ukraine, contributing to efforts to combat corruption, improve the efficiency of the courts, and enhance public trust in the judiciary. Its actions are subject to judicial review to ensure compliance with the law and protect the rights of individuals.
