The Penal Code of Macau (Portuguese: Código Penal de Macau) is the principal statutory instrument governing criminal law in the Macau Special Administrative Region (SAR) of the People’s Republic of China.
Origins and promulgation
- The code was originally enacted by the Portuguese administration of Macau. It was promulgated as Decreto‑Lei n.º 1/96/M (also cited as Decreto‑Lei n.º 1/1995 in some sources) and entered into force on 1 January 1996.
- Upon the transfer of sovereignty on 20 December 1999, the code was retained as part of the legal system of the Macau SAR under the principle of “one country, two systems,” as provided for in the Basic Law of the Macau Special Administrative Region (1999).
Structure and content
- The code is organized into several books and chapters covering general provisions, offences against persons, offences against property, offences against public order, offences relating to public administration, and special provisions on liability and penalties.
- It defines the categories of crimes (e.g., felonies, misdemeanours), the applicable punishments (imprisonment, fines, community service, etc.), and procedural safeguards such as the principles of legality, non‑retroactivity, and presumption of innocence.
Language and official versions
- The original text is in Portuguese, reflecting Macau’s historical legal tradition. An official Chinese translation is also published and used in the courts.

- Since its enactment, the Penal Code has been amended several times to adapt to evolving social needs and international obligations. Notable amendments include:
- 2000 – Adjustments to offenses related to drug trafficking and organized crime.
- 2005 – Introduction of provisions on cyber‑related offences.
- 2010 – Revisions concerning sexual offences and protection of minors.
