1996 Lindsay by-election

The 1996 Lindsay by‑election was a single‑member election for the Australian House of Representatives seat of Lindsay in New South Wales. The by‑election was triggered after the result of the 1996 federal election for the division was declared void by the Court of Disputed Returns on the grounds that the sitting member, Jackie Kelly of the Liberal Party, was ineligible under Section 44 of the Australian Constitution because she held Australian Citizenship of the United Kingdom at the time of nomination and was a serving member of the Australian Defence Force.

The by‑election was held on 5 December 1996. Jackie Kelly contested the seat again as the Liberal candidate and was successful, retaining the electorate for the Liberal Party. The result confirmed the Liberal hold on Lindsay, with the two‑party‑preferred (2PP) vote reported at approximately 55 percent in favour of the Liberal candidate. Voter turnout was comparable to the preceding federal election, and the swing was modest, reflecting the seat’s status as a marginal‑to‑safe Liberal electorate at the time.

The by‑election is notable for being one of the few instances in Australian federal politics where a sitting member’s election was invalidated on constitutional grounds, leading to a subsequent by‑election in which the same candidate was re‑elected.
